1. Agreement to these terms

We are Kinetic Edutainment LLC, a Michigan limited liability company located at 5119 Buckingham, Troy, Michigan 48098. Kinetic Edutainment LLC does business as The Reel Orb. We operate the website thereelorb.com and related scheduling and client tools (together, the "Site"). By accessing or using the Site, you agree to these Terms of Service. If you do not agree, do not use the Site. The Site is intended for adults; you must be at least 18 years old to use it.

2. Our services

The Site describes our mobile planetarium programming for schools, libraries, and events, and lets you schedule a call or request a booking. All bookings and events are governed by a separately signed service agreement between you (or your organization) and Kinetic Edutainment LLC. If these terms conflict with a signed service agreement, the signed agreement controls for that booking.

3. Intellectual property

The Site and its content, including text, graphics, logos, and design, are owned by Kinetic Edutainment LLC or used under license, including show artwork and imagery belonging to their respective producers and licensors. You may browse the Site and print or save pages for your personal or internal organizational use. You may not copy, republish, sell, or exploit Site content for any other commercial purpose without our written permission.

4. Acceptable use

You agree not to use the Site for any unlawful purpose, interfere with its operation or security, misrepresent your identity or affiliation, submit false information through our forms, or access the Site by automated means such as bots or scrapers except as permitted by standard search engines.

5. Third-party links and embedded tools

The Site may link to third-party websites and uses embedded tools, such as our scheduling calendar, provided by service providers. We are not responsible for the content or practices of third-party websites; your use of them is at your own risk and subject to their own terms.

6. SMS text messaging

By opting in to text messaging from Kinetic Edutainment LLC d/b/a The Reel Orb, you expressly consent to receive recurring automated marketing, transactional, and informational text messages (including via an automatic telephone dialing system) at the mobile phone number provided. Messages may include discovery call confirmations, scheduling reminders, booking notifications, event-day logistics updates, and, if separately opted in, promotional offers and new show announcements. Consent to receive text messages is optional and is not a condition of purchasing any goods or services.

Cancellation: You can cancel the SMS service at any time by texting STOP to 248-509-9618 or replying STOP to any message. You will receive one final opt-out confirmation text. To rejoin, sign up as you did the first time and we will start sending SMS messages again.

Rates and frequency: Message and data rates may apply. Message frequency varies based on user interaction. Wireless carriers are not liable for delayed or undelivered messages. If you have questions about your text or data plan, contact your wireless provider.

7. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these terms.

8. Disclaimer

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the fullest extent permitted by law, Kinetic Edutainment LLC and its members, officers, and employees will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site. Our total liability for any claim arising from use of the Site will not exceed one hundred dollars. This section applies to use of the Site; liability in connection with a booked event is addressed in the signed service agreement.

10. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kinetic Edutainment LLC, its members, officers, managers, employees, and agents from and against any third-party claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms of Service; (b) your misuse of the Site; or (c) any false or misleading information submitted by you through our scheduling or booking forms.

11. Governing law and venue

These terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any dispute arising from these terms or the Site will be brought exclusively in the state courts located in Oakland County, Michigan, or the United States District Court for the Eastern District of Michigan, and you consent to the jurisdiction of those courts.

12. Accuracy of submissions and representations

When submitting booking requests, discovery call forms, or contact information through the Site, you warrant and represent that: (a) all information provided is true, accurate, and complete; and (b) if you are submitting requests on behalf of an educational institution, school district, or corporate entity, you have full legal authority to inquire on behalf of and bind such organization.

13. Digital Millennium Copyright Act (DMCA) notice

Kinetic Edutainment LLC respects the intellectual property rights of others. If you believe that any material on the Site infringes upon any copyright that you own or control, please notify our Designated Copyright Agent at:

Your notice must include: (i) identification of the copyrighted work claimed to have been infringed; (ii) identification of the allegedly infringing material; (iii) your contact information; and (iv) a statement that the information in the notification is accurate under penalty of perjury.

14. Class action waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND KINETIC EDUTAINMENT LLC AGREE THAT ANY PROCEEDING TO RESOLVE OR LITIGATE ANY DISPUTE ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR KINETIC EDUTAINMENT LLC WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

15. Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with an updated date, and your continued use of the Site after changes are posted constitutes acceptance.
